Worum es geht

Lumen ist ein Foto- und Videoeditor für iPhone und iPad. Diese Bedingungen gelten zwischen dir und dem unten genannten Anbieter für die Nutzung der App. Den Kaufvorgang selbst wickelt Apple ab; dafür gelten zusätzlich Apples Bedingungen für den App Store und die Apple-Standard-EULA .

Was du bekommst

Du erhältst das nicht ausschließliche, nicht übertragbare Recht, Lumen auf den Geräten zu nutzen, die deinem Apple-Account zugeordnet sind. Die App wird lizenziert, nicht verkauft.

Nicht erlaubt sind das Zurückentwickeln, Verändern oder Weiterverbreiten der App sowie der Versuch, die Kaufprüfung zu umgehen. Zwingende gesetzliche Rechte — etwa auf Dekompilierung zur Herstellung von Interoperabilität — bleiben davon unberührt.

Deine Bilder und Videos gehören dir

An dem, was du mit Lumen bearbeitest, erwirbt der Anbieter keinerlei Rechte. Es gibt auch keinen Weg dazu: die App lädt nichts hoch, und niemand außer dir sieht dein Material. Was du damit tust, ist deine Sache und deine Verantwortung — insbesondere, ob du die Rechte an dem hast, was du bearbeitest.

Lumen Pro

Der Funktionsumfang der Gratis-Version ist vollständig nutzbar, einschließlich Export in voller Auflösung und ohne Wasserzeichen. Lumen Pro wird als automatisch verlängerbares Monats- oder Jahresabonnement angeboten und schaltet unter anderem Scene Lock, Entrauschen, Lichtlecks, die vollständige Look-Liste, die Tonwerkzeuge und eine unbegrenzte Mediathek frei.

Das Abonnement gilt für deinen Apple-Account und lässt sich in der App über „Wiederherstellen" auf weiteren Geräten aktivieren. Um zu erkennen, ob es aktiv ist, fragt die App einen Dienst von RevenueCat — was dabei übertragen wird, steht in der Datenschutzerklärung.

Preis und Laufzeit werden vor dem Kauf in der App angezeigt. Die Zahlung wird deinem Apple-Account belastet. Das Abonnement verlängert sich automatisch, wenn es nicht mindestens 24 Stunden vor Ablauf der aktuellen Laufzeit gekündigt wird. Verwalten oder kündigen kannst du es in den Abonnement-Einstellungen deines Apple-Accounts.

Widerruf und Erstattung

Erstattungen für App-Store-Käufe werden ausschließlich von Apple bearbeitet, nicht vom Anbieter. Der Weg dafür ist reportaproblem.apple.com. Verbraucherinnen und Verbrauchern in der EU steht daneben das gesetzliche Widerrufsrecht für digitale Inhalte zu.

Gewährleistung und Haftung

Lumen wird mit Sorgfalt entwickelt, aber ohne Zusicherung, dass die App fehlerfrei läuft oder für einen bestimmten Zweck geeignet ist. Die gesetzliche Mängelhaftung bleibt unberührt.

Der Anbieter haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit, für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie nach dem Produkthaftungsgesetz. Bei einfacher Fahrlässigkeit haftet er nur für die Verletzung wesentlicher Vertragspflichten und der Höhe nach begrenzt auf den vorhersehbaren, vertragstypischen Schaden. Im Übrigen ist die Haftung ausgeschlossen.

Ein Hinweis, der ernster gemeint ist als er klingt: Lumen arbeitet auf Kopien und lässt dein Original in der Mediathek unangetastet. Behalte trotzdem eine Sicherung deines Materials. Kein Editor ist ein Backup.

Apple

Diese Bedingungen bestehen zwischen dir und dem Anbieter, nicht mit Apple. Für die App und ihren Inhalt ist allein der Anbieter verantwortlich, ebenso für Support und für Ansprüche, die die App betreffen. Apple ist berechtigter Dritter dieser Bedingungen und kann sie dir gegenüber durchsetzen.

Änderungen

Ändert sich etwas an diesen Bedingungen, steht die neue Fassung hier mit neuem Datum. Zwingende Verbraucherrechte bleiben unberührt.

Anwendbares Recht

Es gilt deutsches Recht. Hast du als Verbraucherin oder Verbraucher deinen gewöhnlichen Aufenthalt in einem anderen Staat, bleiben die zwingenden Verbraucherschutzvorschriften dieses Staates unberührt.

What this covers

Lumen is a photo and video editor for iPhone and iPad. These terms are between you and the provider named below, and cover your use of the app. The purchase itself is handled by Apple, and Apple's App Store terms apply to it as well, including the Apple Standard EULA .

What you get

You receive a non-exclusive, non-transferable right to use Lumen on the devices associated with your Apple Account. The app is licensed, not sold.

You may not reverse engineer, modify or redistribute the app, or attempt to circumvent the purchase check. Mandatory statutory rights — such as decompilation for interoperability — are unaffected.

Your photographs and clips stay yours

The provider acquires no rights whatsoever in what you edit with Lumen. There is no route to any: the app uploads nothing, and nobody but you sees your material. What you do with it is yours to decide and yours to answer for — in particular whether you hold the rights to what you are editing.

Lumen Pro

Everything in the free version is fully usable, including full-resolution export with no watermark. Lumen Pro is offered as an auto-renewable monthly or annual subscription and unlocks Scene Lock, denoising, light leaks, the complete look list, the audio tools and an unlimited library.

The subscription belongs to your Apple Account and can be activated on further devices with "Restore" in the app. To tell whether it is active, the app asks a service run by RevenueCat — what that sends is set out in the privacy policy.

The price and period are shown in the app before purchase. Payment is charged to your Apple Account. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. You can manage or cancel it in your Apple Account subscription settings.

Refunds

Refunds for App Store purchases are handled by Apple, not by the provider. The route is reportaproblem.apple.com. Consumers in the EU additionally have the statutory right of withdrawal for digital content.

Warranty and liability

Lumen is built with care, but without a warranty that it will run without fault or suit any particular purpose. Statutory liability for defects is unaffected.

The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For ordinary negligence the provider is liable only for breach of a material contractual obligation, and only up to the foreseeable damage typical for this kind of contract. Liability is otherwise excluded.

One note meant more seriously than it sounds: Lumen works on copies and leaves the original in your library untouched. Keep a backup of your material anyway. No editor is a backup.

Apple

These terms are between you and the provider, not with Apple. The provider alone is responsible for the app and its content, for support, and for any claims relating to the app. Apple is a third-party beneficiary of these terms and may enforce them against you.

Changes

If these terms change, the new version appears here with a new date. A Mandatory consumer rights remain unaffected.

Governing law

German law applies. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country are unaffected.
